These Terms of Service govern the use of ORBIT Social Publisher (“ORBIT”), a social-media management and publishing application operated by Vellure Retail Ltd, trading as Vellure Couture, of 287 Wellingborough Road, Northampton, NN1 4EW, United Kingdom.
1. Purpose of ORBIT
ORBIT is designed to assist authorised users with preparing, managing, scheduling and publishing approved social-media content through supported third-party platforms and their official APIs, including TikTok.
2. Authorised Use
ORBIT may only be used by persons authorised by Vellure Retail Ltd. Users must use ORBIT lawfully and in accordance with the terms, policies and technical requirements of any connected social-media platform.
3. Connected Social-Media Accounts
ORBIT may allow an authorised user to connect a supported social-media account using the platform’s official authorisation process, including OAuth.
Connecting an account does not transfer ownership of that account to ORBIT or Vellure Retail Ltd. Users may disconnect or revoke authorised access through the relevant platform where that functionality is available.
4. Content and Publishing
Users remain responsible for ensuring that content submitted or approved for publication is accurate, lawful and does not infringe third-party rights.
ORBIT may prepare, schedule or transmit approved content to connected platforms. Publication remains subject to the availability, rules, review processes and technical operation of the relevant third-party platform.
ORBIT does not guarantee that a third-party platform will accept, publish, distribute or maintain any particular content.
5. Intellectual Property
Vellure Retail Ltd retains its rights in ORBIT, its associated systems and its proprietary business materials. Content belonging to users, Vellure Couture or third parties remains subject to the applicable owner’s intellectual-property rights.
6. Third-Party Services
ORBIT relies on third-party services and official APIs. Those services operate independently and may change, restrict or discontinue their functionality.
Use of a connected platform remains subject to that platform’s own terms and policies.
7. Security
Reasonable technical and organisational measures are used to protect ORBIT and information processed through it. Authorised users are responsible for protecting their own account credentials and devices.
8. Availability
ORBIT may occasionally be unavailable because of maintenance, updates, third-party service interruptions, API changes or circumstances outside our reasonable control.
Continuous or uninterrupted availability is not guaranteed.
9. Suspension and Termination
Access to ORBIT may be suspended or terminated where necessary for security, legal or operational reasons, or where these Terms or applicable third-party platform requirements are breached.
10. Limitation of Liability
To the extent permitted by applicable law, Vellure Retail Ltd will not be responsible for losses caused solely by outages, restrictions, decisions or technical failures of independent third-party platforms outside its reasonable control.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
11. Privacy
Personal information processed in connection with ORBIT is handled in accordance with the ORBIT Social Publisher Privacy Policy.
12. Changes
These Terms may be updated when ORBIT, applicable law or third-party platform requirements change. The latest version will be displayed on this page with its last-updated date.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction applicable under the laws of England and Wales.
